Statute of Limitations
Hawaii has a two-year statute of limitations for most injury claims. That means that after the two years has passed, you can never make a claim for your injuries.
But, for car accidents, the deadline date is extended whenever a payment is made by the insurance company for Personal Injury Protection also known as PIP benefits. PIP benefits are payments made by your insurance company for the medical bills you incurred because of the car accident.
If you are considering making a claim for an injury caused by someone else’s fault, it may be important to hire an attorney well before the deadline.
If you wait too long you may not be able to find an attorney willing to take your case. The closer it is to the deadline, the harder it will be to fire an attorney.
At that point an attorney may feel like there isn’t enough time to fully evaluate your case, confirm the facts and draft the documents needed to file your lawsuit.
Another important reason its important to hire an attorney earlier rather than later is because there is a potential for roadblocks to your treatment, mistakes and even tricks played by the insurance company
An attorney can help you navigate what can often be a complicated process, giving you more time to focus on your recovery.
That’s why, at the Recovery Law Center, we’re different from some other firms who tell you to call them back when your case is ready. We prefer to be with the client from the beginning, so that we can avoid some of the pitfalls that can come up while you're recovering.
